2. Use of Services
2.1 Eligibility
By using our services, you confirm that you:

- Will use our services in compliance with applicable laws and regulations.
2.2 Account registration and security
To access certain services, you must register for an account and are responsible for maintaining the confidentiality of your login credentials. Any activities under your account are your responsibility, and you must notify us immediately of any unauthorized access or security breaches. You agree to keep your contact details and personal information accurate and up to date.
2.3 Acceptable use
You agree not to use our services for illegal, fraudulent, or unauthorized purposes, interfere with or disrupt Nextbank’s systems, networks, or security measures, misuse or attempt to access restricted areas of our platform, or conduct unauthorized transactions or access another user’s account without permission. Violation of this section may result in account suspension, termination, and legal action.
3. Privacy and Data Protection
By using our services, you acknowledge that we collect and process personal data in accordance with our Privacy Policy. We are committed to protecting your privacy and complying with applicable data protection laws, including the Data Privacy Act of 2012 (Philippines).
4. Transactions
Nextbank provides the technology and infrastructure for financial institutions to process transactions through its core banking system, other solutions, and APIs. Transactions initiated through Nextbank’s platform are subject to verification by the respective financial institution, which is responsible for compliance with applicable regulatory requirements. Users are responsible for ensuring the accuracy of recipient details when making transactions. Transactions may be subject to delays or failures due to system maintenance, third-party integrations, or security reviews.
5. Intellectual Property
All content, trademarks, logos, and intellectual property on our platform are owned or licensed by Nextbank. You may not copy, reproduce, modify, distribute, or create derivative works from our content without prior written consent.
6. Third-Party Services
We may integrate with third-party services, including payment gateways, cloud providers, and financial institutions. Your use of these services is subject to their own terms and conditions. Nextbank is not responsible for third-party failures, disruptions, or security incidents.
7. Limitation of Liability
To the maximum extent permitted by law, Nextbank shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services. We are not responsible for any data loss, unauthorized access, or security breaches beyond our reasonable control, nor for temporary or permanent unavailability of services due to maintenance, security updates, or external factors. Our total liability is limited to the amount paid by you for our services.
8. Suspension and Termination
We may suspend or terminate your account if you violate these Terms, if your actions pose a security risk or legal liability, if required by law or regulatory authorities such as BSP or NPC, or if fraudulent or suspicious activity is detected.
9. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Philippines. Any disputes shall be resolved through negotiation, and if unresolved, through arbitration or legal proceedings in Philippine courts.
